1. GENERAL PART
1.1 This Statute of Кherson State Maritime Academy (hereinafter referred to as the Academy) is developed
in accordance with the laws of Ukraine and is a constituent document governing
the activities of the Academy.
1.2. Кherson State Maritime Academy was established in accordance with the Order of the
Cabinet of Ministers of Ukraine “On the establishment of the Kherson
State Maritime Academy” of June 15, 2011 № 540 and the order
of the Ministry of Education and Science, Youth and Sports of Ukraine “On
measures related to the Kherson State Maritime Academy” dated June 23,
2011. № 616 by reorganization (transformation) of the Higher
Educational Institution “Kherson State Maritime Institute”.
1.3. The Academy is the
legal successor of the Higher Educational Institution “Kherson State
Maritime Institute” and its structural subdivisions: Maritime College and
Professional Maritime Lyceum.
1.4. Name of the Academy:

1.5. Registered address:

1.6. The main tasks of the
Academy are:
1) education of highly
qualified specialists for work in the fields of transport, transport
infrastructure and shipbuilding in accordance with the received specialties;
2) conducting a high level
of educational activities, which ensures that person will obtain the
appropriate degree of higher education in the specialties they choose;
3) providing scientific
activities by conducting research and ensuring the creative activity of
participants of the educational process, training of highly qualified scientific
personnel and the use of the results obtained in the educational process;
4) participation in social
and economic development of the country through human capital formation;
5) formation of personality
through patriotic, legal, ecology-oriented education, affirmation of moral
values, social activity, citizenship and responsibility, healthy lifestyle,
ability to think freely and to self-organize in modern conditions;
6) providing an organic
combination of educational, scientific and innovative activities in the
educational process;
7) creation of necessary
conditions for participants of educational process to realize their abilities
and talents;
8) preservation and
increasing of moral, cultural, scientific values and achievements
of society;
9) dissemination of
knowledge among the population, raising the educational and cultural level of
citizens;
10) establishment of
international relations and implementation of international activities in the
fields of education, science, sports, arts and culture;
11) researching the demand
for certain specialties in the labor market and promoting the employment of
graduates;
12) other areas not
prohibited by current legislation.
1.7. Principles of the
Academy:
1) the activity of the
Academy is based on humanistic, democratic traditions of domestic and world
education, science and culture and is implemented in accordance with the
Constitution of Ukraine, Laws of Ukraine, resolutions of the Verkhovna Rada of
Ukraine, acts of the President of Ukraine, Cabinet of Ministers of Ukraine, as
well as this Statute;
2) regulation of the Academy’s
activity as a higher educational institution is implemented on the basis of the
legislation on education, special legislation on the training of specialists of
the sea and river fleet;
3) works on a non-profit
basis.
1.8. The Academy is a higher
educational institution. The Academy has the right to provide educational
services at the level of qualification requirements for training in working
professions, course professional training and conducts educational activities
in the field of higher education on the basis of licenses.
1.9. The Academy has the
right to train scientific and pedagogical staff through postgraduate and
doctoral studies.
1.10. The educational
process, scientific activity and office work are implemented in the official
language of Ukraine. Reporting is submitted in accordance with the law.
1.11. Activities of
political parties, religious associations and movements during the educational
process at the Academy are not allowed.
2. AUTHORITY OF THE MINISTRY OF EDUCATION AND SCIENCE
OF UKRAINE
2.1. The Ministry of
Education and Science of Ukraine implements the rights and obligations of the
body authorized by the Cabinet of Ministers of Ukraine in relation to the
Academy as the central executive body in the field of education and science,
which subordinates and manages the Academy.
2.2 Ministry of Education and
Science of Ukraine:
1) approves the Statute of
the Academy on the proposal of the Conference of the staff of the Academy,
approves the new edition;
2) in a month term enters
into a contract with the rector of the Academy, elected by competition in the
manner prescribed by the Law of Ukraine “On Higher Education”;
3) at the request of the
Conference of the labor collective of the Academy prematurely terminates the
contract with the rector of the Academy on the grounds specified by labor
legislation, or for violation of the Statute of the Academy, the terms of the
contract;
4) approves the composition
of the Supervisory Board of the Academy;
5) exercises control over
the financial and economic activities of the Academy;
6) exercise other duties
provided by the legislation of Ukraine.
2.3. The Ministry of
Education and Science of Ukraine may delegate some of its powers to the Rector
of the Academy.
3. SCOPE OF CIVIL LIABILITY AND CAPACITY
3.1. The Academy is a legal
entity, the rights and obligations of which it acquires from the moment of its
establishment.
3.2. The Academy may acquire
property and personal non-property rights and have obligations on its own
behalf, be a plaintiff and defendant in court; implements financial and
economic activities in accordance with the legislation of Ukraine, has an
independent balance sheet, has special registration accounts in the State
Treasury Service, current, currency and other accounts in Ukrainian banks, a
seal with the State Emblem of Ukraine and its name, stamps, forms, own symbols,
flag, academic honorary titles, awards, trademark and other attributes of a
legal entity.
3.3. The Academy
independently makes decisions and implements activities within the rights
provided by the legislation and this Statute.
3.4. The Academy has the
right to:
1) develop and implement
educational (scientific) programs within the licensed specialty;
2) determine independently
the forms of education and forms of organization of the educational process;
3) choose the types of
programs for bachelors and masters, provided by the International Standard
Classification of Education;
4) to award degrees of
higher education to applicants for higher education who, in accordance with the
legislation, have successfully passed the attestation procedure after
graduation at the appropriate level of higher education;
5) issue documents on higher
education of the state standard in accredited areas (specialties) and
educational programs and prepare and issue their own documents on higher
education in the manner and according to the model determined by the Academic
Council of the Academy for non-accredited educational programs;
6) independently develop and
implement their own programs of educational, scientific and innovative
activity;
7) employ pedagogical
workers, scientists and other employees;
8) conduct scientific and
scientific-technical examination in accordance with the specifics of the
Academy;
9) form and approve its own
staff list in accordance with the legislation;
10) determine working regime
and rules of internal procedure;
11) make a final decision on
the recognition, including the establishment of equivalence obtained in foreign
higher education institutions of bachelor’s, master’s, doctor of
philosophy, doctor of sciences and academic titles of docent or professor
during enrolment in studying and / or employing in position of scientific,
pedagogical or research and teaching staff;
12) establish the rating
evaluation of education, scientific research and innovation achievements of
participants of the educational process;
13) provide additional
educational and other services (including paid) to individuals and legal
entities in accordance with the legislation;
14) independently introduce
specializations, determine their content and programs of academic disciplines;
15) create, rename,
reorganize and liquidate its structural units;
16) establish publishing
activity, in particular to publish textbooks, manuals and scientific works, and
also to develop its own polygraphic base;
17) establish joint
activities with educational institutions, scientific institutions and other
legal entities on the basis of relevant agreements;
18) place their training,
research and training-research-production units at enterprises, institutions
and organizations;
19) participate in the work
of international organizations;
20) implement its own symbols and attributes;
21) establish its own forms
of moral and material encouragement of participants of the educational process;
22) establish financial and
economic and other activities in accordance with the legislation and the
Statute of the Academy;
23) manage its own revenues,
in particular from paid services;
24) open current and deposit
accounts in banks;
25) change the tuition fee
in accordance with the legislation in the manner prescribed by the agreement
between the Academy and the individual (legal entity);
26) sell products
manufactured by the results of scientific and methodological activities, to
implement the commercialization of research and teaching materials in
accordance with the legislation;
27) use land plots in
accordance with the procedure established by the Land Code of Ukraine;
28) train specialists by
state order, by order of line ministries, enterprises, institutions,
organizations regardless of forms of ownership, local executive bodies, public
organizations and under agreements with individuals or legal entities;
29) establish postgraduate
education (retraining) in specialties;
30) prepare foreigners who
came to Ukraine to study in order to enter institutions of higher education;
31) train foreigners who
came to Ukraine to study at different levels of education in accordance with
the standards of higher education;
32) prepare citizens of
Ukraine for admission to institutions of higher education;
33) receive funds and
material values (buildings, structures, equipment, vehicles, etc.) from the
executive authorities, enterprises, institutions, organizations, citizens and
charitable foundations;
34) conclude cooperation
agreements with companies, institutions and organizations in Ukraine and abroad
to perform statutory tasks in the manner prescribed by laws and regulations;
35) create educational,
educational-scientific and educational-scientific-production complexes, and
health centers, faculties and other structural subdivisions;
36) develop its own social
and domestic base, network of educational, scientific and industrial
institutions and institutions of sports and recreation, health care and
culture;
37) use the benefits
established for higher education institutions;
38) implement economic and
science activities in order to ensure the educational process, scientific and
socio-economic development of the Academy;
39) implement international
cooperation, conclude cooperation agreements, establish direct links with
higher education institutions of foreign countries, international
organizations, foundations in accordance with the legislation of Ukraine;
40) establish international
relations and participate in the activities of international organizations for
the purpose of teaching foreign students;
41) establish various types
of foreign economic activity;
42) to create its own or use
under the contract other material and technical bases for implementation of
educational practice of the persons studying at Academy, and also for its own
economic activity;
43) implement capital
construction, reconstruction, capital and current repairs of fixed assets on a
contract basis or by economic means;
44) allocate funds for the
construction or improvement of social facilities, as well as for social support
of scientific, pedagogical and other categories of employees and students of
the Academy;
45) scientific and
pedagogical employees of the Academy have the right to receive housing,
including office housing, in accordance with the procedure established by law;
46) provide financial
assistance to employees of the Academy and its structural divisions within the
framework of the legislation;
47) create and maintain
teams of professionally-applied and game sports, creative teams and amateur
groups;
48) create databases in
accordance with the needs of educational and research activities;
49) provide, in agreement
with the Ministry of Education and Science of Ukraine for rent without the
right of privatization, areas that are not used in the educational process or for
other needs of the Academy;
50) provide medical
assistance to employees and cadets, students, pupils of the Academy and its
structural units related to the maritime transport of Ukraine, in accordance
with the legislation;
51) operate training and
production vessels in accordance with the procedure established by law;
52) exercise other rights
that do not contradict the legislation of Ukraine.
3.5. The Academy is obliged
to:
1) establish educational
activities in licensed specialties, establish scientific and technical,
innovative and methodological activities aimed at ensuring the educational
process;
2) comply with the
legislation and state standards of Ukraine;
3) fulfill government orders
and obligations under contracts with legal entities and individuals;
4) provide the conditions
necessary for a person to obtain higher education;
5) provide education in
accordance with the standards of higher education;
6) provide professional
development and training of teaching and science staff at least once every five
years, while maintaining the average salary;
7) create appropriate
working conditions, professional development, everyday life, recreation and
medical services for employees of the Academy;
8) establish scientific and
technical activities in accordance with the laws of Ukraine “On
Education”, “On Higher Education” and "On Scientific and
Scientific and Research Activities”, to ensure scientific work as an
integral part of the educational process;
9) ensure the organic unity
of the content of education and research programs;
10) direct fundamental,
applied research and development to the creation and implementation of new
relevant technologies and materials;
11) ensure the direct
participation of students in scientific and development work which is provided
at the Academy;
12) plan the conduct and
implementation of scientific research by scientific and pedagogical workers
within the main working hours;
13) involve leading
scientists, and employees of the Academy and other scientific institutions and
organizations in the educational process;
14) organize scientific, scientific-practical,
scientific-methodical seminars, conferences, Olympiads, competitions of
research, term papers, diploma works and other works of participants of the
educational process;
15) take measures, including
through the introduction of appropriate new technologies, to prevent and detect
academic plagiarism in scientific works of scientific and pedagogical employees
and applicants for higher education and bring them to disciplinary
responsibility;
16) have an internal system
for ensuring the quality of educational activities and the quality of higher
education;
17) create the necessary
conditions for persons with special educational needs to receive education;
18) publish on the official
website, on information stands and in any other way information about rights
and fulfillment of obligations;
19) perform operational
management of buildings, structures, property complexes, equipment, and other
property assigned to the Academy;
20) enter information on
issued diplomas into the Unified State Electronic Database on Education;
21) comply with financial
discipline, accounting and reporting rules;
22) provide information to
requests in accordance with the law;
23) promote and create
conditions for the activities of public and student self-government bodies;
24) promote the participation
of scientific and pedagogical staff of the Academy in international
organizations, associations, etc.;
25) promote social protection
and health improvement of participants of the educational process;
26) preserve and rationally
use the property of the Academy;
27) create safe conditions for
educational, scientific and other activities, and comply with sanitary and
environmental standards;
28) create conditions to
fulfill the cultural needs of employees of the Academy and students.
3.6. The rights and
obligations of pedagogical and scientific workers and persons studying at the
Academy are determined in accordance with the legislation.
3.7. For achieving
significant results in work, employees of the Academy, in accordance with the
procedure established by law, may be presented with state awards and prizes,
certificates of honor and titles, and other types of moral and material
incentives.
3.8. Due to the specifics of the educational process,
the Academic Council of the Academy may set additional requirements for the
qualification of candidates for vacant positions of teaching and research
staff.
4.
STRUCTURE OF THE ACADEMY
4.1. The structure of the
Academy, the status and functions of its structural divisions are determined by
the Statute of the Academy and the regulations on the relevant structural
divisions.
4.2. Structural subdivisions
are formed by the decision of the Academic Council of the Academy in the manner
prescribed by the Law of Ukraine “On Higher Education” and this
Statute.
4.3. The structural
subdivisions of the Academy can be: institutes, faculties, departments,
college, lyceum, laboratories, centers, departments, divisions, libraries,
training centers and other subdivisions that serve the educational process and
research and ensure the activities of the Academy.
4.4. The structural
subdivision of the Academy is the faculty.
The faculty - is a
structural subdivision of the Academy, which unites at least three departments
and / or laboratories and in total provides training of at least 200 full-time
graduates.
The head of the faculty of
the Academy is elected by the academic council of the faculty of the Academy
from among its members taking into consideration the proposals of the staff of
the faculty of the Academy.
The Rector of the Academy
appoints the head of the faculty for a term of five years and concludes a
corresponding contract with him.
The Rector of the Academy
has the right to reasonably refuse to appoint to the position and conclude a
contract. The Academic Council of the Academy has the right to confirm the
previous decision by a two-thirds vote of its members, after which the Rector
of the Academy is obliged to appoint a person to the position and conclude a
contract with him within 10 working days.
The head of the faculty
exercises his powers on a permanent basis.
The faculty is managed by
the dean. The dean of the faculty may delegate part of his powers to his
deputies.
The dean issues orders
related to the activities of the faculty. Dean’s orders are mandatory for
all employees and cadets (students) of the faculty.
The Rector of the Academy
may revoke the orders of the Dean, which contradict the law, the Statute of the
Academy or harm the interests of the Academy.
4.5. The structural
subdivision of the Academy is the department.
Department - the basic
structural unit of the Academy, which conducts educational, methodological and
/ or scientific activities in a particular specialty (specialization) or
intersectoral group of specialties, which includes at least five scientific and
pedagogical staff, for whom the department is the main place of work, and at
least three of them have a scientific degree or academic (honorary) title.
The department is managed by
the head of the department, who is elected to this position by competition by
the Academic Council of the Academy for a term of five years. A contract is
concluded with the head of the department.
4.6. At the enterprises of
sea and river transport may be established branches / laboratory departments of
the Academy, which operate on the basis of separate Regulations, approved in
accordance with the established procedure by the Academic Council of the Academy
and the head of the enterprise.
4.7. The structural
subdivision of the Academy is the Maritime College (Kherson, Ushakova Avenue,
14/1).
The College is a structural
subdivision of the Academy that conducts educational activities related to the
training of specialists of the educational and qualification level of a junior
specialist and obtaining the degrees of junior bachelor and / or bachelor.
The college has the right to
implement educational activities related to obtaining a complete general
secondary education at the level of state requirements and to issue a document
on general secondary education of the state standard.
The election, appointment
and dismissal of the head of the college is implemented in accordance with the
Law of Ukraine “On Higher Education”.
The head of the college acts
on the basis of the Regulations of the college and issues orders concerning the
internal activities of the college.
4.8. The structural
subdivision of the Academy is the Professional Maritime Lyceum (Kherson, 122 Bohorodytska
Street).
The Lyceum is a structural
subdivision of the Academy that ensures the implementation of the needs of
citizens in professional education, mastery of working professions,
qualification in accordance with their interests, abilities and state of
health.
The management of the lyceum
is performed by the director, who is appointed by the order of the rector of
the Academy.
The director acts on the
basis of the Regulations on the lyceum and issues orders concerning the
internal activities of the lyceum.
4.9. Other structural
subdivisions may be created in the Academy to fulfill the statutory tasks and
requirements of the legislation of Ukraine.
5. MANAGEMENT OF THE ACADEMY, ELECTION, APPOINTMENT
AND DISMISSAL OF THE RECTOR OF THE ACADEMY
5.1. The direct management of the Academy is
implemented by the Rector of the Academy. The rights, duties and
responsibilities of the rector are determined by the legislation of Ukraine and
the Statute of the Academy.
5.2. The Rector is a representative of the Academy in
relations with state bodies, local governments, legal entities and individuals
and acts without a power of attorney within the powers provided by the Law of
Ukraine “On Higher Education” and the Statute of the Academy.
5.3. Rector of the Academy within the powers granted
to him:
1) organizes the activities of the Academy;
2) decide on financial and economic activities of the
Academy approves the structure and staff list;
3) issues orders and directives, gives mandatory
instructions for all participants of the educational process and structural
units of the Academy;
4) is responsible for the results of the Academy’s
activities to the Ministry of education and science of Ukraine;
5) is the administrator of property and funds;
6) ensures the implementation of the financial plan
(estimate), concludes agreements;
7) appoints and dismisses employees;
8) provides labor protection, observance of law and
order;
9) determines the functional responsibilities of employees;
10) forms a contingent of people studying at the
Academy, ensures objectivity and openness of admission to the Academy;
11) expels applicants for higher education from the
Academy and resumes their studies at the educational institution in agreement with
the student self-government bodies and the primary trade union organization of
students (if the person is a member of a trade union) on the grounds established
by the Law of Ukraine “On Higher Education”;
12) ensures the organization and establishment of
control over the implementation of educational and professional programs,
curricula and programs of academic disciplines;
13) monitors compliance by all divisions with staff
and financial discipline;
14) exercise control over the quality of work of scientific
and pedagogical and other employees;
15) ensures the creation of conditions for effective
and open public control over the activities of the Academy;
16) promotes the formation of a healthy lifestyle
among applicants for higher education, strengthening the sports and health base
of the Academy, creates appropriate conditions for mass sports;
17) together with the elected bodies of the primary
organizations of trade unions of employees of the Academy and students submits
for approval to the Conference of the staff of the Academy the Rules of
Procedure and the Collective Agreement and after approval signs them;
18) submits for consideration of the Academic Council
of the Academy submissions on the formation, renaming, reorganization and
liquidation of structural units of the Academy;
19) promotes and creates conditions for the activities
of public bodies, including student self-government, Scientific Society of
students, graduate students, doctoral students and young scientists, trade
unions of employees and students of the Academy, public organizations operating
in the Academy;
20) in accordance with the legislation, the Collective
Agreement and the provisions on the procedure for awarding employees of the
Academy determines the procedure, sets the amount of surcharges, allowances,
bonuses, financial assistance and incentives for scientific, pedagogical, and
other employees of the Academy, and imposes penalties on them;
21) organizes the international activity of the
Academy;
22) exercise other powers provided by the Statute.
5.4. The Rector of the Academy is responsible for the
implementation of educational, scientific and innovative activities in the
Academy, for the results of financial and economic activities, condition and
preservation of real estate and other property of the Academy.
5.5. The Rector of the Academy reports annually to the
Ministry of Education and Science of Ukraine and the Conference of the Academy’s
staff.
5.6. The Rector is obliged to publish the annual
report on his activities on the official website of the Academy.
5.7. The Rector of the Academy may delegate part of
his powers to vice-rectors and heads of structural subdivisions.
5.8. The Rector of the Academy in accordance with the
Statute may delegate part of his powers to his deputies and heads of structural
units with the right to sign documents of the Academy with full responsibility
in accordance with the law.
5.9. In case of temporary absence of the Rector of the
Academy, the performance of his duties is entrusted to the First Vice-Rector or
another person in accordance with the division of functional responsibilities
determined by the Rector.
5.10. To address the main issues of activity in
accordance with the Statute, the Rector of the Academy creates working and
advisory bodies, as well as determines their powers.
5.11. In order to fulfill the terms of the agreement
“On cooperation between the Ministry of Education and Science, Youth and
Sports of Ukraine, the Company “Marlow Navigation”, Kherson
regional state administration and Kherson State Maritime Academy in improving
the quality of Maritime education in Ukraine” dated 08.10.2011 the
Academy introduced the adviser to the rector and the possibility of assigning
him the title of “Honorary rector of Kherson State Maritime
Academy”.
5.12. In order to improve the efficiency of management
activities, preserve and increase the best traditions, continuity, and assist
in improving the educational process, scientific and educational work upon
retirement from the position of the rector of the Academy, a person who has
worked in this position for at least ten consecutive years is appointed as an
adviser to the rector at the expense of the Academy’s own revenues. The
rector’s adviser is paid in the amount of the average salary that the
person received before retiring from the position of rector.
Peculiarities of appointing the Rector’s Adviser
and assigning him the title of “Honorary Rector of the Kherson State
Maritime Academy” are determined by the Regulations on the Rector’s
Adviser of the Kherson State Maritime Academy, which is approved by the
Academic Council of the Academy.
In his activity the Rector’s Adviser is guided
by this Statute and the Regulations on the Rector’s Adviser of the
Kherson State Maritime Academy.
5.13. A Candidate for the position of rector of the
Academy must be a citizen of Ukraine, be fluent in the state language, have an
academic title and a scientific degree, and have at least 10 years of
experience in the position of scientific and pedagogical worker.
5.14. Candidates for the position of the Rector of the
Academy may be nominated by the staff of the Academy or its structural
subdivision, the primary trade union organization of the Academy, as well as by
self-nomination.
The same person may not be appointed to the post of
rector of the Academy for more than two terms.
5.15. A person cannot be selected or appointed
(including acting) to the position of rector of the Academy, if:
1) by a court decision recognized as incapacitated or
whose legal capacity is limited;
2) has a criminal record for committing a crime, if
such a criminal record is not extinguished or removed in accordance with the
procedure established by law;
3) in accordance with the court’s verdict, is
deprived of the right to hold the relevant positions;
4) by a court decision, was found guilty of committing
a corruption offense - within a year from the date of entry into force of the
relevant court decision;
5) was subject to an administrative penalty for a
corruption offense - within a year from the date of entry into force of the
relevant court decision;
6) falls under the third part of Article 1 of the Law
of Ukraine “On Purification of Power”;
5.16. The procedure for electing the rector of the
Academy consists of the following stages:
1) announcement of the competition and acceptance of
documents from the candidates for the position of the rector;
2) preparation of elections;
3) holding elections.
5.17. The Ministry of Education and Science of Ukraine
announces a competition for the position of the Rector of the Academy not later
than two months before the expiration of the contract of the person holding
this position. In case of early termination of the powers of the Rector of the
Academy, the competition is announced within a week from the date of formation
of the vacancy.
5.18. The Ministry of Education and Science of Ukraine
within two months from the date of announcement of the competition for the
position of Rector of the Academy accepts proposals for applicants for the
position of Rector and within 10 days from the deadline for submission of
proposals, submits candidates who meet the established requirements to the
Academy for voting.
5.19. The following have the right to participate in
the election of the Rector of the Academy:
every scientific, scientific-pedagogical and teaching
staff member of the Academy;
representatives from among other full-time employees,
who are elected by the respective employees by direct secret election;
elected representatives from among cadets (students) who
are elected by cadets (students) by direct secret election.
In this case, the total number of scientific and
pedagogical employees of the Academy must be at least 75 percent of the total
number of persons entitled to participate in the elections; the number of
elected representatives from among other employees of the Academy - up to 10
percent, and the number of elected representatives from among cadets (students)
- not less than 15 percent of persons entitled to participate in the elections.
5.20. The features of the electoral system of the
Rector of the Academy are governed by the Law of Ukraine “On higher
education” taking into account Methodical recommendations about features
of the electoral system and procedure of election of head of higher educational
establishment approved by the Cabinet of Ministers of Ukraine of 5 December
2014 No. 726, and this Statute.
5.21. Elections are considered to have taken place if
more than 50 percent of the total number of persons eligible to participate in
the elections, each of whom has one vote and votes in person, took part in it.
5.22. The Ministry of Education and Science of Ukraine
shall conclude a contract with a person (candidate) who received more than 50
percent of the votes of persons entitled to participate in the elections for a
period of five years not later than one month from the date of his election.
5.23. The Rector of the Academy may be dismissed by
the Ministry of Education and Science of Ukraine, as well as in connection with
the decision to recall him by the conference of the Academy’s staff, who
elected him on the grounds of labor law, for violation of the Academy’s
charter and contract. . A petition for the recall of the Rector of the Academy
may be submitted to the conference of the staff of the Academy by at least half
of the statutory members of the Supervisory or Academic Council of the Academy.
The decision to recall the Rector of the Academy is made by a majority vote
subject to the presence of at least two-thirds of the statutory composition of
the conference of the staff of the Academy.
5.24. The Academic Council of the Academy is a
collegial body formed for a term of five years. Academic Council of the Academy:
1) determines the strategy and perspective directions
of development of educational, scientific and innovative activity of the
Academy;
2) develops and submits to the conference of the labor
collective of the Academy the draft statute of the Academy, as well as the
decision on making changes and additions to it;
3) approves the financial plan and annual financial
report of the Academy;
4) defines the system and approves the procedures for
internal quality assurance of higher education;
5) make decisions on the placement of own revenues in
the territorial bodies of the central body of executive power in the field of
treasury servicing of budget funds or in banking institutions;
6) decides on the proposal of the rector of the
Academy on the formation, reorganization and liquidation of structural units of
the Academy;
7) elects heads of departments, professors and
associate professors, library directors, branch managers through a competition
by secret ballot;
8) approves educational programs and curricula for
each level of higher education and specialty;
9) makes decisions on the organization of the
educational process, determines the terms of study at the appropriate levels;
10) approves the sample and procedure of preparation
of its own document of higher education, regulations on the procedure and
grounds for its issuance to graduates, as well as samples, procedure and
grounds for issuance of joint and double diplomas to graduates;
11) approves the main directions of scientific
research and innovation;
12) evaluates the scientific and pedagogical activity
of structural units;
13) assigns the academic titles of professor,
associate professor and senior researcher and submits the relevant decisions
for approval to the attestation board of the Ministry of Education and Science
of Ukraine;
14) make final decisions on the recognition of foreign
documents on higher education, scientific degrees and academic titles during
the employment of pedagogical, scientific, and other employees, as well as
during the enrollment of entrants;
15) has the right to submit a petition to recall the
Rector of the Academy on the grounds provided by law, this Statute, the
contract, which is considered by the conference of the staff of the Academy;
16) considers other issues of the Academy’s
activity in accordance with this Statute and legislation.
5.25. The academic Council of the Academy is headed by
its Chairman, who is elected by secret ballot of the members of the academic
Council of the Academy who have an academic degree and/or an academic
(honorary) title, for the term of the Academic Council.
The Academic Council of the Academy includes the
following positions: Rector of the Academy, Vice-Rectors of the Academy, heads
of faculties, Academic Secretary, Director of the Library, Chief Accountant,
heads of self-government bodies and elected bodies of primary trade union
organizations of the Academy, as well as elected representatives who represent
scientific and pedagogical workers and are elected from among the heads of
departments, professors, doctors of philosophy, doctors of science, elected
representatives who represent other employees of the Academy and work in it on
a permanent basis, elected representatives of postgraduates, doctoral students,
trainees, assistant trainees, heads of elected bodies of primary trade Union
organizations of students and postgraduates, heads of student self-government
bodies of the Academy in accordance with the quotas defined by this Statute.
Elections to the Academic Council shall begin 30
calendar days before the expiration of the term of office of the previous
Academic Council.
According to the decision of the Academic Council, it
may also include representatives of employers’ organizations. At the same
time, not less than 75% of the Academic Council must be scientific and
pedagogical staff of the Academy and not less than 10% - elected
representatives from among students (cadets).
Elected representatives from among the employees of
the Academy are elected by the Conference of the staff of the Academy at the
request of the structural units in which they work, and elected representatives
from among the students (cadets) are elected by students (cadets) by direct
secret ballot.
Decisions of the Academic Council of the Academy are
put into effect by decisions of the Rector of the Academy.
Academic councils of structural subdivisions may be
established in the Academy, the powers of which are determined by the Academic
Council of the Academy in accordance with this Statute. The Academic Council of
the Academy may delegate part of its powers to the Academic Councils of
structural subdivisions.
5.26. The
collegial governing body of the faculty of the Academy is the academic council
of the faculty.
The Academic Council of the Faculty is headed by its
chairman, who is elected by secret ballot of members of the Academic Council of
the Faculty who have a scientific degree and / or academic (honorary) title,
for the term of the Academic Council of the Faculty.
The Academic Council of the Faculty includes Deputy
Deans, Heads of Departments, Heads of Self-Government Bodies of the Faculty,
Heads of Student Self-Government Bodies of the Faculty, as well as elected
representatives representing research and teaching staff and elected from among
professors, doctors, elected representatives representing other employees who work
in a faculty on a permanent basis, and elected representatives from among the
persons studying at the Academy, in accordance with the quotas defined by the
Statute of the Academy.
At the same time, 75% of the total number of members
of the Academic Council of the Faculty should be scientific and pedagogical
staff of the Faculty and not less than 10% - elected representatives from among
the students studying at the Academy.
Elected representatives are elected by the conference
of the faculty staff at the request of the structural units in which they work,
and elected representatives from among the students studying at the Academy are
elected by the highest body of student self-government of the faculty.
5.27. The competence of the Academic Council of the
faculty includes:
1) determination of general directions of scientific
activity of the faculty;
2) election to office by secret ballot of the dean,
assistants, teachers, senior teachers, associate professors;
3) approval of curricula and study plans;
4) solution of issues related to the organization of
the educational process at the faculty;
5) approval of the financial report and financial plan
of the faculty.
Decisions of the Academic
Council of the Faculty are put into effect by the decisions of the Dean of the
Faculty.
The decision of the Academic
Council of the Faculty may be revoked by the Academic Council of the Academy.
5.28. The collegial body of
the college is the pedagogical council, which is headed by the head of the
college and which acts in accordance with the law.
5.29. The collegial body of
the lyceum is the pedagogical council, which is headed by the director of the
lyceum and which acts in accordance with the law.
5.30. To address current issues
of the Academy, working bodies are created - the administration, deans of
faculties, admissions committee, etc., which act on the basis of regulations on
them, approved by the Academic Council of the Academy in accordance with this
Statute.
5.31. The Rectorate is a
working governing body of the Academy, designed for systematic coordination of
operational issues. The Rectorate discusses the most important issues of
educational, scientific, economic activities of the Academy, which are
submitted for discussion by the Rector.
The Rectorate is headed by the
Rector, who determines the personal composition of the Rectorate.
5.32. The Rectorate is
convened and conducted by the rector. Heads of structural subdivisions,
pedagogical, scientific-pedagogical and other employees of the Academy may be
invited to the Rectorate.
5.33. The Dean’s office
is the governing body of the faculty and operates under the direction of the
dean. The Dean’s office consists of the dean, deputy dean, secretary. The
number of deputy deans and secretaries depends on the number of students.
5.34. The admission committee
is created for the organization and implementation of admission of entrants to
the Academy. Separate admissions committees are set up at the Maritime College
and the Professional Maritime Lyceum. Their main task is to form a contingent
of students, cadets and students of all forms of education.
5.35. In order to develop a
strategy and directions of educational and / or scientific activities of the
Academy, the rector has the right to form advisory bodies (employers’
council, investor council, business council, student council, scientific
council, administrative council, etc.) on a voluntary basis. Advisory bodies
act on the basis of the provisions on them approved by the Academic Council of
the Academy in accordance with this Statute.
5.36. To supervise the
management of the Academy's property, compliance with the purpose of its
creation by the decision of the Ministry of Education and Science of Ukraine,
the Supervisory Board is formed at the Academy.
The Supervisory Board is
formed of representatives of state and local governments, the scientific
community, socio-political organizations and economic entities, approved by the
Conference of the Academy, at the request of the Academic Council of the
Academy. Applicants and employees of the Academy may not be members of the
Supervisory Board.
5.37. The Supervisory Board is
guided by the Constitution of Ukraine, laws of Ukraine “On
Education”, “On Higher Education”, decrees of the President
of Ukraine, resolutions of the Cabinet of Ministers of Ukraine, orders of the
Ministry of Education and Science of Ukraine, regulations governing the
functioning of higher education institutions, and by this Statute.
5.38. The main tasks of the
Supervisory Board are:
1) consideration and analysis
of priority areas of modernization of the Academy in the field of educational,
scientific, scientific-technical and innovative activities;
2) assistance in solving
perspective tasks of the Academy development;
3) assistance to the Academy’s
management in the implementation of state policy in the field of higher
education and science;
4) attracting financial
resources to support the Academy's activities in the main areas of development
and monitoring of their usage;
5) promoting effective
interaction of the Academy with state bodies and local governments, the
scientific community, socio-political organizations and economic entities in
the interests of development and improving the quality of educational activity
and competitiveness of the Academy;
6) assistance to the Academy in improving
the material and technical base of the educational process, scientific and
technical activity, its social infrastructure;
7) exercising public control over the activity of the Academy;
8) promoting the integration of the Academy into the international educational
system, finding ways to expand and improve the international cooperation of the
Academy.
5.39. Members of the
Supervisory Board have the right to:
1) participate in the work of
the higher collegial body of public self-government of a higher education
institution with the right of an advisory vote;
2) participate in determining
the development strategy of the Academy and monitor its implementation;
3) to promote the attraction
of additional sources of funding;
4) analyze and evaluate the
activities of the Academy and the Rector;
5) control the implementation
of the budget of the Academy and make appropriate recommendations and proposals
that are mandatory for consideration by the rector;
6) submit to the Ministry of
Education and Science of Ukraine a proposal to encourage or recall the rector
on the grounds specified by law;
7) exercise other rights
defined by this Statute of the Academy.
5.40. The Supervisory Board
operates on a voluntary basis, guided by the principles of collegiality and
publicity.
5.41. The Supervisory Board
has the right to submit to the highest collegial body of public self-government
of the Academy and / or the Ministry of Education and Science of Ukraine the
recall of the Rector of the Academy on the grounds provided by law, the Statute
of the Academy and the contract.
5.42. The term of office of
the Supervisory Board is five years.
5.43. The organizational form
of the Supervisory Board’s work is meetings, which are usually convened
at least once a year. The date and place of the meeting of the Supervisory
Board are determined by its chairman.
5.44. In case of absence of
the Chairman of the Supervisory Board for valid reasons, the meeting of the
Board shall be held by his Deputy.
5.45. The Supervisory Board,
within its powers, makes decisions, organizes and monitors their
implementation.
5.46. A meeting of the
Supervisory Board is valid if at least two thirds of its members are present.
5.47. Organizational and
logistical support of the Supervisory Board is provided by the Academy.
6.
BODIES OF PUBLIC SELF-GOVERNMENT
6.1. The highest collegial
body of public self-government of the Academy is the Conference of the labor
collective, including elected representatives from among the cadets (students)
studying at the Academy.
6.2. The conference is
convened by the decision of the administration and trade union committees of
employees and cadets and the student council at least once a year.
6.3. Conference delegates are
elected for a term of three years.
6.4. The Conference is an
elected body, its quantitative and statutory composition is determined at the
time of election of a new composition depending on the number of staff units in
the Academy, in accordance with the Regulations on the Conference.
6.5. The delegates of the
conference are: rector, vice-rectors, head of the college, director of the
lyceum, deans of faculties, chairman of the trade union organization, chairman
of the cadet (student) self-government, chairman of the trade union of cadets
(students).
6.6. All categories of
participants of the educational process of the Academy should be represented in
the Conference. At the same time, at least 75% of the delegates of the elected body
must be scientific and pedagogical staff of the Academy, who work on a
permanent basis, and not less than 15% - elected representatives from among
cadets (students) elected by direct secret elections.
6.7. The conference is
convened at least once a year. Extraordinary meetings of the Conference may be
held.
6.8. The conference of the
Academy is considered competent if at least two thirds of the delegates from
its statutory composition take part in it.
6.9. The conference performs
the following functions:
1) approves the Charter of the
Academy, as well as changes (additions) to it in the new edition upon
submission of the Academic Council;
2) hears the annual report of
the rector of the Academy and evaluates his activity;
3) elects a commission on
labor disputes in accordance with the Labor Code of Ukraine;
4) considers and adopts the
draft of the collective agreement and grant the trade union committee the
authority to sign this agreement on behalf of the collective;
5) approves the rules of
internal labor regulations of the Academy;
6) considers the issue of
early termination of the powers of the head of the Academy upon a substantiated
submission of the Academic Council of the Academy;
7) considers other
issues of the Academy’s activity.
6.10. For the term
of office of the Conference (three years) the permanent presidium of the
Conference is elected consisting of the chairman of the Conference, his deputy
and the secretary. The presidium consists of the rector of the Academy and the
chairman of the trade union committee of the Academy.
6.11. The working
bodies of the Conference during its holding are the Presidium, the Counting
Commission, the Secretariat.
6.12. The order of
work and holding of the Conference is regulated by the Regulations on the
Conference of the staff of the Academy.
6.13. The agenda
of the Conference is formed by the Rector, the Academic Council, the
participants of the Conference and approved by a simple majority of those
present.
6.14. decisions of
the Conference are made by open voting by a majority of the votes of the team
members present at the Conference.
6.15. The body of
public self-government of structural subdivisions is the General Meeting of the
labor collective of the subdivision.
7. BODIES OF STUDENT SELF-GOVERNMENT
7.1. The Academy
and its structural subdivisions have student, cadet and student self-government
(hereinafter - student self-government), which is an integral part of the
public self-government of the Academy.
Student
self-government is participated by students who study in the Academy.
All persons
studying at the Academy have an equal right to participate in student
self-government.
Student government
ensures the protection of the rights and interests of students in the
educational institution and their participation in the management of the
Academy. Student self-government is implemented by persons studying at the
Academy, directly and through student self-government bodies elected by secret
ballot.
7.2. Student
self-government bodies are guided by the legislation, decisions of the Ministry
of Education and Science of Ukraine, the Statute of the Academy and the
Regulations on student self-government.
7.3. Student government bodies:
1) adopt acts
regulating their organization and activity;
2) conduct
organizational, scientific, cultural, sports, health and other activities;
3) promote the
employment of persons studying at the Academy;
4) dispose funds
and other property on their balance and bank accounts;
5) perform other
functions.
7.4. In agreement
with the student government at the Academy, a decision is made on:
1) expulsion of
cadets (students) from the Academy and their renewal for study;
2) transfer of
persons studying at the Academy by state order to study under a contract at the
expense of individuals (legal entities);
3) transfer of
persons who study at the Academy at the expense of individuals (legal entities)
to study by state order;
4) appointment of
the Deputy Dean of the Faculty, Deputy Head of the Academy;
5) settlement of
persons studying at the Academy in a dormitory and their eviction from the
dormitory;
6) approval of the
internal regulations of the Academy in the part concerning the students;
7) activities of
campuses and dormitories for accommodation of persons studying at the Academy.
7.5. Student
government is implemented at the level of the academic group, course, faculty,
specialty, dormitory of the Academy, etc.
7.6. The highest
body of student self-government is the Conference of cadets and students who
study at the Academy and who:
1) approve
regulations on student self-government of the Academy, determine the structure,
powers and procedure for holding direct secret elections of representative and
executive bodies of student self-government;
2) listen to the
reports of representative, executive and control-audit bodies of student
self-government, give them an appropriate assessment;
3) approve the
procedure of using property and funds of student self-government bodies,
support of student initiatives on a competitive basis;
4) approve the
annual cost estimate (budget) of student self-government bodies, make changes
and additions to it, hear a report on its implementation;
5) elect a control
and revision commission from among students (cadets) to implement current
control over the state of use of property and budget execution of student
self-government bodies.
7.7. The Conference of students and
cadets includes: one delegate from each academic group and trade union of
cadets, students and pupils, the scientific society of cadets, as well as the
Student (cadet) council of the Academy.
7.8. The Rector of
the Academy should comprehensively promote the creation of appropriate
conditions for the activity of student self-government bodies (provision of
premises, furniture, office equipment, provision of telephone communication,
constant access to the Internet, allocation of places for information stands,
etc.).
The financial
basis of student self-government is the funds determined by the Academic
Council of the Academy in the amount of 0.5% of the special fund of the
Academy.
Funds of student
self-government bodies are directed to the performance of their tasks and
powers. At least 30% of the funds should be spent on supporting the scientific
activities of students at the Academy.
7.9. Student
self-government bodies can take various forms (senate, parliament, student
educational (scientific) part, student deans’ offices, councils, etc.).
7.10. The
administration of the Academy has no right to interfere in the activity of
student self-government bodies.
8.
INTERNATIONAL COOPERATION AND FOREIGN ECONOMIC ACTIVITY
8.1. The Academy has the right to establish
international cooperation, to conclude agreements on cooperation, to establish
direct relations with higher educational institutions of foreign states,
international organizations, foundations, etc. in accordance with the norms of
the legislation.
8.2. The main areas of international cooperation of
the Academy are:
1) implementation of joint research;
2) participation in programs of bilateral and
multilateral interstate exchange of students, cadets, pupils, graduate
students, pedagogical and scientific workers;
3) organization of international conferences,
symposia, congresses and other events;
4) participation in international educational and
scientific programs;
5) joint publishing activity;
6) provision of services related to higher and
postgraduate education to foreign citizens in Ukraine;
7) business trips abroad of scientific and pedagogical
staff for teaching and research work in accordance with international
agreements of Ukraine, as well as direct agreements of the Academy with foreign
partners.
8.3. The foreign economic activity of the Academy is
established in accordance with the legislation of Ukraine and this Statute by
concluding agreements with foreign legal entities and individuals.
8.4. The main types of foreign economic activity of
the Academy are:
1) organization of professional training and
internship of students, cadets, employees;
2) implementation of educational activities related to
the education of foreign students, as well as training of scientific personnel
for foreign countries;
3) performance of research and development works
commissioned by foreign legal entities and individuals;
4) creation of joint ventures, centers, laboratories
with foreign partners.
8.5. Currency and material revenues from the foreign
economic activity of the Academy are used to ensure the fulfillment of
statutory tasks.
9.
PROPERTY AND FUNDS OF THE ACADEMY
9.1. The material and technical base of the Academy
includes buildings, structures, land, communications, equipment, vehicles and
other material values.
In accordance with the legislation, buildings,
structures, property complexes, communications, equipment, vehicles, and other
property are assigned to the Academy in order to ensure its statutory
activities.
Land use and realization of the rights of the owner of
land plots, including acquisition of the corresponding rights to the earth, is
established by Academy according to the Land Code of Ukraine.
9.2. Property assigned to the Academy may not be the
subject of collateral, and may not be seized or transferred to the ownership of
legal entities and individuals without the consent of the Ministry of Education
and Science of Ukraine and the Conference of the Academy staff, except as
provided by legislation.
The Academy’s own revenues received from fees
for services provided in accordance with educational, scientific, educational
and industrial activities, charitable contributions and grants are credited to
special registration accounts opened in the territorial body of the central
executive authority in the field of treasury services of budget funds, or in
accordance with the procedure established by law, to current and deposit
accounts of state Bank institutions.
These revenues, as well as interest received from the
placement of the Academy’s funds on deposit accounts in state-owned
banks, are included in the financial plan (estimate) of the Academy and can be
used to purchase property and its use, capital construction and renovation,
improvement of material technical, educational-laboratory,
educational-methodical support of the educational process, etc. within the
statutory activity of the Academy.
The lease of property assigned to the Academy is
implemented without the right of redemption in accordance with the law.
The buildings, structures and premises of the Academy
must meet the requirements of accessibility in accordance with state building
norms and standards. If the relevant facilities cannot be fully adapted to the
needs of people with special educational needs, they are reasonably adapted to
the universal design.
9.3. The Academy in the manner prescribed by law and
in accordance with its Statute has the right to:
1) to establish a permanent fund (endowment) of the
Academy and dispose of revenues from its use in accordance with the conditions
of functioning of the permanent fund, as well as to receive property, funds and
valuables, including buildings, structures, equipment, vehicles, from state
bodies, local governments, legal entities and individuals, including as
charitable assistance;
2) own objects of intellectual property rights created
at their own expense or from state or local budgets (except in cases specified
by law);
3) conduct financial and economic activities in
Ukraine and abroad;
4) use the property assigned to it on the right of
economic management, including for business activities, transfer it for rent
and use in accordance with the law;
5) create its own or use under the contract other
material and technical bases for educational, scientific, innovative or
economic activities;
6) create and develop its own base of social
facilities, a network of sports and health, medical and preventive, cultural
and artistic structural divisions;
7) implement construction, reconstruction, capital and
current repairs of fixed assets;
8) allocate funds for social support of scientific and
pedagogical, and other employees of the Academy and students of the Academy;
9) open current and deposit accounts in national and
foreign currencies in accordance with the legislation.
9.4. Financing of the Academy is implemented at the
expense of the state budget on the terms of the state order for payment of
services on preparation of experts, scientific and pedagogical staff and at the
expense of other sources which are not forbidden by the legislation, in
particular:
1) funds received for training, retraining, advanced
training of specialists, provision of additional educational services in
accordance with the concluded agreements with legal entities and individuals;
2) income from the lease of premises, equipment;
3) gratuitous and charitable contributions of legal
entities and individuals, including from other countries;
4) receipts for the implementation of contractual
issues under contracts with enterprises, institutions, organizations and
individuals;
5) other income in accordance with the legislation.
9.5. Remuneration at the Academy is implemented in
accordance with the Labor Code of Ukraine, the laws of Ukraine “On
Education”, “On Higher Education”, “On
Remuneration”, “On Professional Education” according to
salary schemes and tariff rates set by the Cabinet Ministers of Ukraine.
9.6. Forms and system of remuneration, conditions and
indicators of bonuses for employees of the Academy, the procedure for
establishing allowances for high achievements in work or for the period of
particularly important work, as well as the procedure for establishing and
abolishing surcharges for employees for combining positions, expanding service
areas, duties temporarily absent employees is determined by the Collective
Agreement.
9.7. Revenues from the main and additional activities,
or parts thereof, received by the Academy are not subject to distribution among
the founders (participants), employees (except for payment of their labor,
accrual of the single social contribution), members of management bodies and
other related persons.
Revenues are used by the Academy for scientific and
technical, design and engineering research, training of scientific personnel,
development of material and technical and social base, social support of
employees, as well as for other purposes determined by this Statute and not
contrary to law.
10.
PROCEDURE OF REPORTING AND CONTROL OVER FINANCIAL AND ECONOMIC ACTIVITY
10.1. In accordance with the Budget Code of Ukraine,
laws of Ukraine “On Accounting and Financial Reporting in Ukraine”
and other regulations, the Academy prepares approved forms of monthly,
quarterly and annual reports and submits them to the Ministry of Education and
Science of Ukraine, the State Treasury Service of Ukraine, State Fiscal
Service, State Statistics Committee, Pension Fund of Ukraine, Social Insurance
Funds.
10.2. The Academy independently implements operational
and accounting of its work, conducts statistical reporting in accordance with
the established norms, submits it in the prescribed manner to the bodies to
which the legislation of Ukraine gives the right to control the relevant areas
of activity.
10.3. The Rector and the Chief Accountant of the
Academy are personally responsible for the accuracy of accounting and
statistical reporting.
10.4. The audit of the Academy’s activity is
implemented in accordance with the legislation of Ukraine.
11.
CONCEPT OF THE ACADEMY’S EDUCATIONAL ACTIVITY
11.1. The educational activity of the Academy is based
on the conceptual principles of the National Doctrine of Education Development,
the laws of Ukraine “On Education”, “On Higher
Education”, “On Professional Education”.
11.2. The main purpose of the Academy is to provide
the conditions necessary for a person to receive quality education.
11.3. Educational activities are based on the
following principles:
1) humanism;
2) democracy;
3) inheritance of spiritual possessions;
4) continuity and succession;
5) personal orientation of education;
6) openness and accessibility;
7) consistency and multivariance;
8) the continuity and integration;
9) social orientation;
10) compliance with the requirements of the present
and the future;
11) constant improvement and ability to change;
12) advanced innovative development of education;
13) integration into the European and world
educational space;
14) the formation of national and universal values.
11.4. Target activity programs and ways of their
implementation:
1) systematic development of multilevel and
postgraduate education, improvement of the organization, forms, methods and
content of education on the basis of continuity and continuity of education;
innovative nature of educational work; orientation and ability of the
individual to self-study; diversity of educational services, variability of educational
programs, individualization of education;
2) combination of traditional methods and new
information and computer technologies in the educational process, information
support of the educational process on the basis of the unity of the information
space; personal orientations; integration of traditional and new information
and computer technologies;
3) fundamentalization and humanization of learning,
development of creative personality on the basis of harmonization of relations
between man, society and nature; creating preconditions and opportunities for
continuous self-education in a rich information space;
4) development of modern specialties of education on
the basis of integration of lyceum, college and Academy, continuity and
optimality of education;
5) improvement of management, provision of personnel
support of educational process and scientific research on the basis of
integration of management system; high professionalism; demanding and
responsibility;
6) labor market monitoring, tasks on employment of
Academy graduates through the unity of training and employment; individuality
of approaches;
7) development of scientific research, creation and
implementation of technical and technological developments, integration of
educational and scientific processes on the basis of the inseparability of
science in the Academy from scientific and technical policy in the education
system of Ukraine; conformity of forms of scientific, technical and innovative
activity to driving forces of socially-oriented market economy; balance of
fundamental research and scientific work and development, which are implemented
in production; activity in the scientific and technical market;
8) development of international cooperation in the
field of science and education on the basis of priorities of national
interests; focus on national, European and universal fundamental values;
systemic and mutually beneficial nature of cooperation;
9) development of social infrastructure and promotion
of social protection of employees and students, cadets, students on the basis
of the priority of life and health; availability and targeting of social
assistance; diversity of social support; unity of interests and tasks of social
infrastructure;
10) principles and conditions of education and
self-development of the individual on the basis of the unity of national and
universal; activity and creative initiative; humanization and democratization
in approaches to education; unity of education and upbringing; differentiation
and individualization of education;
11) economic and financial self-sufficiency, direction
of economic activity and material support of the Academy on the basis of
systematic economic, financial and economic activity; multi-channel financial
support system;
12) the concept of educational activity is
supplemented and detailed by the concepts of educational activity of faculties,
departments, other subdivisions of the Academy and is embodied in the plans of
educational activity of structural subdivisions.
11.5. The further development of the Academy and its
structural subdivisions will contribute to the solution of problems in the
training of personnel capable of ensuring the coordinated and economically effective
operation of all modes of transport in the system of International Transport
Corridors, namely:
1) Introduction of a degree system of higher
education;
2) ensuring high academic and professional mobility of
specialists to significantly reduce the time of adaptation in the real
conditions of professional activity and reduce the financial costs of
retraining and advanced training of marine professionals;
3) formation of the content of maritime education in
accordance with the requirements of the International Maritime Organization,
the International Labor Organization and the Conceptual principles of education
and training of ship crew members in higher educational institutions of
Ukraine;
4) implementation of modern training technologies and
simulators to ensure a high level of professional and practical training;
5) providing the educational process with highly
qualified pedagogical and scientific staff;
6)
improvement of material and technical, educational and laboratory base and
social infrastructure of the higher educational institution;
7) ownership of the situation on the personnel labor
market, strengthening direct ties with shipping companies, ship repair and
shipbuilding enterprises, employers;
8) improvement of the structure and scope of training,
retraining and advanced training at the level of qualification requirements for
various professions and specialties used on sea and river vessels, shore
enterprises and organizations;
9) search for sources of funding for training,
retraining and advanced training of specialists. Involvement of shipping
companies, enterprises, coastal infrastructure organizations, individuals in
financing.
11.6. The Academy establishes special forms of
educational process due to the peculiarities of the training of seagoing
vessels, aimed at developing cadets' self-service skills, collective eating,
long-term living in a closed or limited space as part of a small team,
observance of daily routine, watchkeeping, namely:
1) performing shift duty at the Academy;
2) watchkeeping on training and production vessels;
3) accommodation in the cadets’ dormitory
“Ekipazh”;
4) collective nutrition;
5) wearing uniforms not only by cadets, but also by
certain categories of employees.
12.
SCIENTIFIC, RESEARCH AND TECHNICAL AND INNOVATIVE ACTIVITY
12.1 Scientific, research
and technical activity of Academy is an integral part of educational activity
and its implementation is aimed at integration of scientific, educational and
production activities. Scientific activity is done according to requirements
Laws of Ukraine “On education”, “On higher education”,
“On scientific and research and technical activity” and other
regulating documents.
12.2 Main objectives of
scientific, research and technical and innovative activity of Academy are:
1) integration of
educational process, science, production;
2) utilization in
educational process of achievements of science and research and technical
progress, results of research investigations;
3) participation in
educational process of research and engineering staff;
4) participation of teaching
staff in performing of fundamental and applied researches, creation of research
and technical production;
5) performance of researches
by teaching staff in the frames of their working hours;
6) participation of
students, post-graduate students, research and teaching staff in scientific
conferences and creative competitions;
7) implementation of full
cycle of research and technical activity – from fundamental, research
investigations to implementations of the results into practice.
12.3 Main areas of
scientific, research and technical and innovative activity of Academy are:
1) fundamental and applied
research in humanities, natural and technical areas (state, international
programs, grands or private funding);
2) creation of research and
technical production, performance of investigation and design, design and
technology works of private funding in accordance with separate agreements;
3) performance of scientific
and research and technical expertise, expert investigations, provision of
scientific and research and technical services (state, international programs, grands
or private funding);
4) publishing of research
works, monographs, textbooks and dictionaries;
5) cooperation with research
institutions of National Academy of Sciences of Ukraine, national branch
academies of sciences;
6) implementation of created
innovative products into industry, other branches of economy;
7) obtaining, guarding and
protection of intellectual property rights, connected with the results of scientific,
research and technical activity;
8) production and disposal
of science-containing products.
12.4 Subjects of scientific,
research and technical and innovative activity of Academy are research and
teaching staff, individuals obtaining education at Academy, other employees of
Academy, involved in scientific, research and technical and innovative
activity. Pedagogical and other staff of Academy, leading professionals of
other institutions may be engaged into scientific investigation and research and
design activity of Academy.
12.5 Academy plans
scientific, research and technical and innovative activity based on Thematical
plan of scientific investigation and research and design activity resulted from
contests and based on the agreements; it plans conduction of research
investigations in the frames of working hours by teaching staff; it performs
expert assessment of research and investigation activity; it exercise the
intellectual property right.
Scientific, research and
technical and innovative activity of Academy is arranged and managed by
Vice-rector on research and education.
12.6 All kinds of scientific
investigation are performed by scientific and research and investigation
structural subdivisions which are coordinated by Vice-rector on research and
education.
12.7 Scientific, research
and technical and innovative activity may be performed inter alia through
created by the Academy legal entities; the object of activity of legal entities
is perfection of the results of scientific and research and technical activity
of the Academy to the condition of
innovative product with its further commercialization.
12.8 “Scientific
association of cadets” (hereinafter referred to as Association) operates
at Academy having units in structural subdivisions (at faculties).
12.9 Association is a part
of public self-government of Academy, its units are formed in a democratic
manner.
12.10 Funding of scientific,
research and technical and innovative activity is done in accordance with
regulatory documents inter alia funded through:
1) funds of State budget
allocated for performance of fundamental and applied researches, research and
technical developments in the framework of Thematical plan; state funds
allocated for development of latest technologies; funded by State targeted
programs; according to the agreements with State Fund of Fundamental
Researches;
2) funds received by the
Academy for creation of research and technical products, performance of
scientific and investigation, research and design works as well as for
scientific expertize service according to private agreements, grands etc.;
3) own funds of Academy,
sponsor contributions, loans and other sources allowed by current legislation.
12.11 Organizational forms
of performance of scientific, research and technical and innovative activity,
intellectual property rights of Academy and participants of educational process
and their protection are defined by Law of Ukraine “On higher
education”.
12.12 Obtaining, guarding
and protection of rights of Academy and participants of educational process
connected with the results of scientific, research and technical and other
kinds of activities are provided according to legislation. Academy has the
right to handle property rights for the objects of intellectual property.
12.13 Academy implements
measures to prevent academic plagiarism – disclosure (partial or full) of
scientific results received by other individuals as the results of own
investigation and/or coping of published texts of other authors without corresponded
references.
13. PROCEDURE OF AMENDING OF THE ACADEMY’S STATUTE
13.1.
The Charter of the Academy is developed by the Academic Council of the Academy
and submitted for approval to the Conference of the staff of the Academy, after
which the Statute is submitted for approval to the Ministry of Education and
Science of Ukraine.
13.2.
Changes and additions to the Charter of the Academy are implemented in the new
edition and approved in the same order as the Charter itself.
14. PROCEDURE OF REORGANIZATION AND LIQUIDATION OF THE
ACADEMY
14.1.
Liquidation and reorganization (merger, accession, division, transformation) of
the Academy are implemented in accordance with the legislation of Ukraine.
14.2.
The liquidation of the Academy is implemented by a liquidation commission set
up by the Ministry of Education and Science of Ukraine. The liquidation
commission includes representatives of the Ministry of Education and Science of
Ukraine and the Academy. The procedure for liquidation, as well as the deadline
for filing claims by creditors is determined by the Ministry of Education and
Science of Ukraine.
14.3.
From the moment of appointment of the liquidation commission, the powers to
manage the Academy are transferred to it. The liquidation commission takes the liquidation
balance of the Academy and submits it for approval to the Ministry of Education
and Science of Ukraine.
14.4.
Creditors and other legal entities that have a contractual relationship with
the Academy shall be notified of its liquidation in written form.
14.5.
In case of liquidation of the Academy (merger, acquisition, division,
separation or transformation) its assets are transferred to one or more
non-profit institutions (organizations) of the relevant type, or credited to
the budget, unless otherwise provided by law governing the activities of the
non-profit institution.
14.6.
During the liquidation and reorganization of the Academy, the dismissed
employees and students are guaranteed the observance of their rights and
interests in accordance with the legislation of Ukraine.
